미국에 살고있는 “모든 한인들” 에게는 무슨 의미인가?

“난민 행정정책” 의 사실과 진실은?
1. ”무슬렘 금지” 가 아닙니다. 행정 명령문을 읽어보면(맨아래 영문참조), 거기에는 이슬람 또는 다른 종교를 언급하지 않았습니다. “무슬렘금지, 무슬렘 차별, 인종차별” 등의 표현들은 CNN 뉴스와 진보주의 주류미디아들이 자의적으로 붙인 단어들이며 “친이슬람정책” 을 강력히 펼친 오바마/힐러리 정부가 사용한 전략이기도 합니다 – 미국시민들로 하여금 무슬림을 우리가 인종차별하는거처럼 죄의식을 느끼게 만드는 전략.
2. 트럼프대통령의 “난민/방문자 행정명령” 목적은?
첫째, 무고한 사람들의 입국을 금지하는것이 아니라, 종교를 명목으로 테러를 범하는 범죄인들 과 범죄인일수있는 사람들을 엄격하게 확인하는 절차이며 “테러자” 들을 미리 차단하여 미국의 안전을 지키기 위함입니다 (Sec. 1 & 2 참조).
둘째, ISIS 테러 단체들이 점령한 중동(Middle East) 국가들로부터 난민들을 미국이 꼭 받아야한다면 종교적이유로 가장 많은 핍박과 죽임을 당하는 난민들을 우선순위로 받겠다는것입니다. (Sec. 5 (B) 참조)
셋째, 지난 8년간 오바마정부에 의해 친이슬람 정책들이 정치는 물론이거니와 “Political Correctness” 라는 명목으로 공립학교 교육, 문화, 사회안에 깊이 들어와서 차세대들을 brainwash 시키고, 미국의 헌법과 미국을 건국했던 가치관들도 변질시키며 비민주주의적이고 비미국적인 외국나라의 법 (예: 이슬람 샤아리아법)을 미국헌법안에 포함시키는것을 합법화 시키고자 했었기 때문에 그동안 보수기독교인들과 단체들이 가장 크게 우려했고 미국의 회복을 위해 기도해왔었습니다. 2015년 12월에는 민주당에서 샤아리아법을 미국의 법으로 인정하는 절차를 만들기위해 이슬람을 차별하거나 기분상하게 하는 단어나 언급을 금지하는 HR569 법안을 통과시키려고했다가 다행히 통과못시켰지만, 만일 이번 대선에서 오바마정권이 계속 이어져서 이법안이 통과됬었다면, 지금쯤 더 많은 크리스천들과 보수파들이 “이슬람포비아, 인종차별주의”라는 별명을 받을뿐 아니라, 미국안에서까지 크리스천에 대한 핍박은 상상이상으로 더 심각하게 고조되고 또한 늘어났을것입니다.

넷째, 트럼프 대통령과 새로운 정부가, 미국이 친이슬람화 되는것을 심각하게 우려하며, “미국을 다시 미국으로 회복되길” 원했던 침묵의 대다수이자 전통가치관을 존중하는 미국 시민들에게 약속한것을 지키고있는 것이라고 할수있겠습니다.

3. ISIS 테러를 그동안 가장 많이 일으킨 전력을 가지고 있는 “이라크, 이란, 시리아, 리비아, 소말리아, 수단, 예멘 중동국가들” 에게 적용됩니다. 참고로, 2011년, 오바마도 이라크에서 오는 난민들을 잠시 금지한적이 있었고, 2016년에 오바마 역시 같은 국가들에게만 Visa Waiver Program (VWP – 비자 없이도 미국을 방문할수있는 프로그램-1986년에 미국과 친한 38개의국가들을 위해 시작됨) 을 잠시 중단하고 비자를 받고 들어오게 하였었는데, 그때는 지금처럼 오바마를 반대하는 소동은 없었습니다.

켈리앤 콘웨이 백악관 보좌관은 “2015년에 테러 방지법에서 지정된 7개의 국가는 테러범들을 훈련하고 은닉하며 수출까지 하는 역사를 가지고 있다” 라고 발표했는데, 미국 보안 수사팀에 의해 여러번 검증된 사실입니다.
문제는, 그럼에도 불구하고 2016년에 미국이 세계에서 중동무슬림난민들을 가장 많이 받았다는 기록들이며 미국 역사상 최초로 무슬림난민들을 가장 많이 받았다는 리포트입니다 (Pew Research 및 여러리포트2016). 특별히, ISIS 테러를 가장 많이 일으키는 나라중 하나인 시리아에서 오바마정부가 2016년 받아드린 12,000명 이상의 시리아 난민들중 크리스천 난민은 100명(0.5%) 도 채 안된다는 리포트입니다.

참고로, 당시, 그동안 미국안에서까지 일어나는ISIS 관련 테러사건들이 늘어나자 공화당에서는 오바마정부에게 제안하기를 ‘중동이나 시리아에서 난민을 받을 것이라면 미국시민들의 안전을 위해서라도 차라리 가장 핍박을 많이 받고 있는 기독교인 난민들을 받자’ 라고 2016년에 제안했었지만, 그들의 제안에 오바마 전대통령은, “공화당은 종교차별주의자들이며 인종차별주의자들” 이라고 오히려 비난하여, CNN을 비롯하여 거의 모든 주류 미디아들은 오바마 전대통령이 언급한 “종교차별주의, 인종차별주의” 및 “무슬림 포비아 공화당” 이라고 까지 거듭 보도했을뿐 아니라 지금까지 그 단어들은 테러를 막고자 하는 사람들에게도 사용하고 있다는 안타까운 사실입니다.
5. 입국금지령 문서를 읽어보면 매우 조건적이며 상식적입니다. 금지령에는 예외(exception) 리스트가 있고 테러국가들에서 “가장 위협을 받고있는 난민들을 받는것” 으로 적혔습니다. 따라서, ISIS 테러와의 연결이나 테러 위협이 있을 수 있는 난민 혹은, 난민으로 가장한 사람들에 대한 금지령이며, 금지령은 그들에 대한 신상파악이 명확해지면 풀립니다.
또한, 행정명령이 떨어진 첫 36시간에는 주류미디아의 왜곡된 뉴스들로 수많은 혼돈이 있었고 지금도 있지만, 미국 국토보안국Department of Homeland Security (DHS) 이 지난 주일(1/29/17)에 확인해준바에 의하면, 위의 7국가에서 들어오는 사람들중, 미국에 테러와같은 “심각한 위협-serious threat” 이 없다는것이 확인되는 미영주권자나 시민권자들을 문제없이 받아주며 최선을 다해 미국시민(어떤 출생지사람이든) 들을 보호하기 위한 경계와 존중을 할것이며 case by case 로 검토 할것이라고 했습니다. 또한, 7 중동국가에서 오는 사람들중, 이중국적을 가진 사람들은 그들이 미국에 들어오면서 보여주는 “국적” 에 의해 검토될것이다 라고 했습니다.

6. 보안에 대한 유예기간은 일시적입니다. “보안 위험” 으로 명명 된 7 개국의 시민들은 향후 90 일동안 또는 신분확인이 확실할때까지 미국에 입국 할수없습니다. 따라서 난민에 대한 처우도 120 일 동안 중단됩니다. 트럼프 대통령은 “시리아 난민의 입국이 미국의 국가 이익과 부합하는지 , 미국에 확실히 안전한지 확인이되고 USRAP에 그러한 검증이 입증될수있고 시스템에 충분한 변화가 이뤄졌다고 판단 할 때까지” 지속될 것이다 라고 했습니다. (Sec. 5 참조)
7. 이 행정 명령은 미국시민들을 보호하기 위한 필수적 보안측정이지 주류미디아가 말하는 “이슬람 포비아” 나 “무슬림 입국금지 정책 –Muslim Ban”이 아닙니다.

PROTECTING THE NATION FROM FOREIGN TERRORIST ENTRY INTO THE UNITED STATES
By the authority vested in me as President by the Constitution and laws of the United States of America, including the Immigration and Nationality Act (INA), 8 U.S.C. 1101 et seq., and section 301 of title 3, United States Code, and to protect the American people from terrorist attacks by foreign nationals admitted to the United States, it is hereby ordered as follows:
Section 1. Purpose. The visa-issuance process plays a crucial role in detecting individuals with terrorist ties and stopping them from entering the United States.
Perhaps in no instance was that more apparent than the terrorist attacks of September 11, 2001, when State Department policy prevented consular officers from properly scrutinizing the visa applications of several of the 19 foreign nationals who went on to murder nearly 3,000 Americans. And while the visa-issuance process was reviewed and amended after the September 11 attacks to better detect would-be terrorists from receiving visas, these measures did not stop attacks by foreign nationals who were admitted to the United States.
Numerous foreign-born individuals have been convicted or implicated in terrorism-related crimes since September 11, 2001, including foreign nationals who entered the United States after receiving visitor, student, or employment visas, or who entered through the United States refugee resettlement program. Deteriorating conditions in certain countries due to war, strife, disaster, and civil unrest increase the likelihood that terrorists will use any means possible to enter the United States. The United States must be vigilant during the visa-issuance process to ensure that those approved for admission do not intend to harm Americans and that they have no ties to terrorism.
In order to protect Americans, the United States must ensure that those admitted to this country do not bear hostile attitudes toward it and its founding principles. The United States cannot, and should not, admit those who do not support the Constitution, or those who would place violent ideologies over American law. In addition, the United States should not admit those who engage in acts of bigotry or hatred (including “honor” killings, other forms of violence against women, or the persecution of those who practice religions different from their own) or those who would oppress Americans of any race, gender, or sexual orientation.
Sec. 2. Policy. It is the policy of the United States to protect its citizens from foreign nationals who intend to commit terrorist attacks in the United States; and to prevent the admission of foreign nationals who intend to exploit United States immigration laws for malevolent purposes.
Sec. 5. Realignment of the U.S. Refugee Admissions Program for Fiscal Year 2017.
(a) The Secretary of State shall suspend the U.S. Refugee Admissions Program (USRAP) for 120 days. During the 120-day period, the Secretary of State, in conjunction with the Secretary of Homeland Security and in consultation with the Director of National Intelligence, shall review the USRAP application and adjudication process to determine what additional procedures should be taken to ensure that those approved for refugee admission do not pose a threat to the security and welfare of the United States, and shall implement such additional procedures.
Refugee applicants who are already in the USRAP process may be admitted upon the initiation and completion of these revised procedures. Upon the date that is 120 days after the date of this order, the Secretary of State shall resume USRAP admissions only for nationals of countries for which the Secretary of State, the Secretary of Homeland Security, and the Director of National Intelligence have jointly determined that such additional procedures are adequate to ensure the security and welfare of the United States.
(b) Upon the resumption of USRAP admissions, the Secretary of State, in consultation with the Secretary of Homeland Security, is further directed to make changes, to the extent permitted by law, to prioritize refugee claims made by individuals on the basis of religious-based persecution, provided that the religion of the individual is a minority religion in the individual’s country of nationality. Where necessary and appropriate, the Secretaries of State and Homeland Security shall recommend legislation to the President that would assist with such prioritization.
Sec. 10. Transparency and Data Collection. (a) To be more transparent with the American people, and to more effectively implement policies and practices that serve the national interest, the Secretary of Homeland Security, in consultation with the Attorney General, shall, consistent with applicable law and national security, collect and make publicly available within 180 days, and every 180 days thereafter:
(i) information regarding the number of foreign nationals in the United States who have been charged with terrorism-related offenses while in the United States; convicted of terrorism-related offenses while in the United States; or removed from the United States based on terrorism-related activity, affiliation, or material support to a terrorism-related organization, or any other national security reasons since the date of this order or the last reporting period, whichever is later;
(ii) information regarding the number of foreign nationals in the United States who have been radicalized after entry into the United States and engaged in terrorism-related acts, or who have provided material support to terrorism-related organizations in countries that pose a threat to the United States, since the date of this order or the last reporting period, whichever is later; and
(iii) information regarding the number and types of acts of gender-based violence against women, including honor killings, in the United States by foreign nationals, since the date of this order or the last reporting period, whichever is later; and
